The new packaging law comes into force on 01.01.2019 – What do you need to know as an online retailer?

New rules for packaging material, adhesive tape and fillers are the most important. Therefore, no online retailer should hesitate here for a long time, but implement the innovations directly. The new Packaging Act is the successor to the Packaging Ordinance and aims to minimize waste and increase the recycling rate of packaging materials. In the process, the manufacturers are to be asked to pay for the disposal of packaging materials and thus assume more product responsibility.

Chargeable licensing or participation fees are introduced in the dual system, whereby the costs for the return and recycling of these packages are to be financed by the dual systems. With the new packaging law, traders are obliged to register with the “Stiftung Zentralstelle Verpackungsregister” in order to escape a fine of up to 200,000 euros.

In order to provide an opportunity for inspection, there will be a public register for all companies that place “packaged” packaging on the market. So packaging that is incurred by the end user for disposal. Further details on the registration will be announced by the authority.

It is planned that certain manufacturers of the Central Unit of the Packaging Register will have to submit a completeness declaration every year in May, which will then be examined. This declaration contains all sales and outer packaging placed on the market for the first time this year. However, there are limits of at least 50,000 kilograms of paper, cardboard and cardboard per year. For many online retailers, this will not be a big problem, as they usually do not achieve these values.

However, this only applies to manufacturers and distributors who place a certain quantity of packaging subject to systemic marketing on the market for the first time. These thresholds for paper, cardboard and cardboard are at least 50,000 kilograms per calendar year – a value that is at least not achieved in normal online trading.
